New Anti-gun Legislation Introduced in Congress

From the moment the recent tragedy in Las Vegas hit the news, we knew we would have to brace for shock and wait for the fallout. Several states have bills pending. There will be the usual sabre rattling from the normal characters, of course. The question that matters most is, “How do they purpose to infringe on the Second Amendment this time?” We have the answers. Here is a list of the most recent anti-gun measures that have recently been proposed in Congress.

H.R.3984 – Rep. Schiff, Adam B. [D-CA-28] (Introduced 10/05/2017) Summary: To repeal the Protection of Lawful Commerce in Arms Act, and provide for the discoverability and admissibility of gun trace information in civil proceedings.

The Protection of Lawful Commerce in Arms Act (PLCAA) protects firearms manufacturers and dealers from being held liable when crimes have been committed with their products.

H.R.3962 – Rep. Watson Coleman, Bonnie [D-NJ-12] (Introduced 10/04/2017) Summary: To require face-to-face purchases of ammunition, to require licensing of ammunition dealers, and to require reporting regarding bulk purchases of ammunition.

This measure is designed to eliminate online sales of ammunition.

H.R.3986 – Rep. Velazquez, Nydia M. [D-NY-7] (Introduced 10/05/2017) Summary: To provide for the establishment of a national standard for incorporating a passive identification ability into all firearms sold in the United States.

The simple translation is require all firearms sold to have smart gun technology.

H.R.3987 – Rep. Velazquez, Nydia M. [D-NY-7] (Introduced 10/05/2017) Summary: To reduce gun violence, fund gun violence research and victim assistance, and enhance the tracking of lost and stolen firearms, and for other purposes.

Any transaction involving at least on firearm, would have a $1 fee added. The money collected would then be distributed as follows: (1) The first $10,000,000 shall be available, without further appropriation, to the Centers for Disease Control and Prevention to carry out section 391(c) of the Public Health Service Act, as added by section 3. (2) The next $5,000,000 shall be available, without further appropriation, to the Attorney General, for the operation and maintenance of the national instant criminal background check system established under section 103 of the Brady Handgun Violence Prevention Act. (3) The remainder shall be available, without further appropriation, to the Attorney General for such activities of the Office for Victim Assistance of the Federal Bureau of Investigation as the Attorney General deems appropriate.

S.1945 – Sen. Menendez, Robert [D-NJ] (Introduced 10/05/2017) Summary: To regulate large capacity ammunition feeding devices.

In truth, there is not much new here, but the threat is as serious as it ever was.

  1. Sadly we have already lost a great deal of the ideals of our very wise founding fathers when one can who incredible accuracy predict how a Justice will vote based on this political affiliation. We need to at every opportunity remind them that their job is to rule on the constitutionality of a law or action, not to make law.

  2. I too thought that this blog was for gun owners only. This “advent” of liberal left patient zeros should not have happened. Attacking the law of the land reveals this disease – and no, the Constitution is not a “living document” unless 3/4 of the States agree to a Constitutional Convention, and then 3/4 of the States agree to oust the Second Amendment. And that will not happen, not with the disention between people today. Until such happens, the Constitution is written in stone, and there isn’t much anyone can, or will do anything about it.

  3. I am a gun/rifle owner. I love the 2nd amendment regardless of what political affiliation I am. I have been shooting competitively since I was in High school how could I not care what happens to it if I can no longer do what I love doing.

  5. A very well thought out choice of quotes! Tyranny hides behind every politician who thinks the dear people cannot think or take care of themselves. Every example of gun violence is going to raise these “politicians” to try to take away our firearms “for our own good”. Yet we hear little, if anything about the instances where a gun SAVED lives. The media is so extremely biased against firearms that they are an outrage to the gun owner. The really sad thing is this: Las Vegas is only the beginning of the large scale mass murders we will see in the future. Will we be transformed into a 1984 society because of a mass murder numbering in the hundreds? This just happened in the Middle East by a truck bomb killing over 300. What will we do when it here? Surrender everything that has been used to kill since the dawn of time?

  6. Thank you for making my point Joe. The separation clause does not exist as a legal document from the government. As for the intent of Jefferson. One should find out why the founders left the monarchy. What you will find is the monarchy wanted to designate a particular religion as the only recognized church. As for the courts. We may soon find the 2nd amendment before the SCOTUS. So if they tamper with the liberty of the 2nd. Does that mean the constitution is evolving as those on the left proclaim? A living document as it were. And if you think the left is wrong about that. I will assume that LBJ’s rider that forbids the organized church from speaking out against political leaders is acceptable. If the US government or some folks among the citizenry want the Christian church to be silenced. It would seem as though we’re not as free as we think. Interpretive law is a slippery slope.

    1. Force Recon Marine, may God abundantly bless you. You are the nation’s finest. I pray that 2nd amendment supporters will fight this fight while you rest. Gun owners must come together with one voice, once and17 for all . Thank you for your sacrifice and commitment to this nation.

    2. @forceReconMarine Wow Seriously? Apparently, the Corps is still brainwashing you. Stop drinking the cool-aide. Think for yourself. This isn’t a left or right issue or religious issue it is a constitutional issue. I like to think myself a constitutionalist and believe that it is a living document and it should change with the times so that it does not leave the country stagnant. What we need is cool and level heads and centrists to take account the will of the people. I served my country for 12 years, my Marine Corps and politics was never injected into our military daily life we only cared about our buddies and went where we were told to go no matter if it was a Democrat or a Republican telling us to do it, The Armed forces fight for the people, not one political party or one man and fights to preserve the Constitution of the United States of America. I consider my self a down the middle American and I have fought for the protection of the constitutions and especially the 2nd amendment. The hate and finger pointing needs to stop. You are an American above all else… remember that.

    3. Well I’ve never got involved with a blog before. Now I am sure that was the right decision. In short, when I hear terms like hate and finger pointing when there is none. After the last 8 years. It sound like an establishment liberal. The days of left, center left, center right or right are over. Its time for Americans to stand firmly in the land of absolute. And if the constitution of the republic of the United States is a living document. Open to evolve with each generation’s likes and dislikes. Just gather up your guns and turn them over. Have we learned nothing after the last 8 years. Who will decide what the second amendment means? Left , center left, center right or right? And this is a blog for gun owners!

    4. Joe you say you’re a constitutionalist but you lack key understandings of of the Constitution. First the Constitution cannot and should not be changed easily to do so would plunge the country into a dictatorship or monarchy because of rash emotion driven decisions or straight up power grabs. Second if a power is not listed in the Constitution the federal government shouldn’t act. That right belongs to the states and even the states are limited by the Constitution, but as many of us see the government has taken powers that it should not have unless one has been living under a rock for the majority of their life. It was far simpler to write Constitution to say what the government can do verses what it can’t do. Finally for the time being the Constitution was never intended to be a living document, but a pillar to uphold the country and values. So the proper way to look at the amendment process is more of a refining process to it truly make it better and withstand the test of time, not a change at the whim of every tragedy or every generation of the population. To do so is foolhardy and will lead to ruin.
